Terms and Conditions of the technokabel.com.pl Website
1. General Provisions
1.1. These Terms and Conditions define the rules for using the website technokabel.com.pl (hereinafter referred to as the “Service”) available at https://www.technokabel.com.pl/. The legal basis for these Terms and Conditions is the Act of 18 July 2002 on the provision of electronic services.
1.2. The operator of the Service and the controller of personal data is Technokabel S.A., with its registered office at ul. Nasielska 55, 04-343 Warsaw, entered into the National Court Register under number KRS 129682, NIP 526-021-37-87, REGON 010560659. In matters related to personal data protection, contact may be made via: rodo@technokabel.com.pl.
1.3. These Terms and Conditions are made available free of charge on the Service in a form that enables downloading, playback and storage.
1.4. By using the Service, each user accepts the provisions of these Terms and Conditions. In the case of Users who are Consumers (natural persons using the Service outside their professional activity), acceptance does not affect their mandatory statutory rights.
1.5. These Terms and Conditions define the rules for using the Service and the content made available therein, while the rules for processing personal data and cookies are specified in a separate document entitled “Privacy Policy”.
2. Copyright and Intellectual Property
2.1. All copyrights to the Materials and other elements of the Service (texts, graphics, photographs, page layout) belong to Technokabel S.A. or entities with which the company has concluded appropriate agreements.
2.2. Materials made available in the Service, including catalog cards, certificates, declarations, technical information and other documents from the “Downloads” and “Knowledge Zone” sections, are provided for informational purposes only. Their distribution, copying, reproduction or further resale/sublicensing without explicit consent in documentary or written form from Technokabel S.A. is prohibited. The use of Materials as part of the User’s business activity (professional use) is permitted.
2.3. The User has the right to download and use the Materials solely for professional purposes under a non-exclusive and non-transferable license. Further distribution of the Materials without explicit consent in documentary or written form from Technokabel S.A. is prohibited.
2.4. Materials within the meaning of these Terms and Conditions include all content available in the Service in textual, graphic, audio or video form, including catalog cards, certificates, declarations, technical information and other documents in the “Downloads” and “Knowledge Zone” sections.
3. Rules for Using the Service
3.1. The Service is for informational purposes only. It does not conduct online sales nor allow contracts to be concluded.
3.2. Technokabel S.A. provides the following free electronic services: (a) access to the content of the Service, (b) access to the Contact Form, (c) access to Materials in the “Downloads” and “Knowledge Zone” sections. These services are provided once at the request of the User. The agreement for the provision of these services is concluded when the User enters the Service and terminates when the User leaves the Service.
3.3. Information contained in the Service, including catalog cards, certificates and other technical materials, does not constitute an offer within the meaning of the Civil Code. Such information may be changed without prior notice. Any errors, inaccuracies or omissions in product descriptions and documentation cannot form the basis for claims against Technokabel S.A. Furthermore, Technokabel S.A. shall not be liable for indirect losses, loss of profits, loss of data or consequential damages resulting from reliance on information contained in the Service.
3.4. The User undertakes to use the Service in accordance with applicable law, good practice and these Terms and Conditions. It is prohibited to provide unlawful content, including spam, advertisements, racist, pornographic, hateful content or any content violating the rights of third parties.
3.5. When using the contact form, the User undertakes to provide accurate data. Such data is processed in accordance with the Privacy Policy.
4. Security and Technical Liability
4.1. Technokabel S.A. makes every effort to ensure that the Service operates properly and is free from threats; however, it does not guarantee that the Service will operate without interruptions or errors.
4.2. Technokabel S.A. shall not be liable for damages resulting from interruptions in the operation of the Service, technical errors, viruses or other threats unless the damage was caused intentionally by Technokabel S.A. In the case of Consumers, the liability of Technokabel S.A. is determined according to general legal principles.
5. Compatibility with Mobile Devices
5.1. The Service is optimized for mobile devices; however, some functions may operate differently depending on the operating system and browser.
6. External Links
6.1. The Service may contain links to external websites. Technokabel S.A. is not responsible for the content or privacy policies of such websites.
7. Digital Accessibility
7.1. Technokabel S.A. strives to ensure accessibility of the Service in accordance with WCAG 2.1 guidelines. In case of accessibility issues, please contact sekretariat@technokabel.com.pl.
7.2. A User who is a Consumer may use out-of-court complaint and claim settlement procedures, including via the ODR platform (http://ec.europa.eu/consumers/odr/).
8. Archiving of the Terms and Conditions
8.1. Subsequent versions of the Terms and Conditions will be archived and made available upon request by the user. In case of doubt, the version currently published in the Service shall apply.
8.2. Technokabel S.A. reserves the right to amend these Terms and Conditions at any time for valid reasons (changes in law, changes in Service functionality). Users will be informed about changes by publishing a new version of the Terms and Conditions on the website. The change shall enter into force within 7 days from the date of publication. Changes do not affect rights acquired by Users before they enter into force.
9. Final Provisions
9.1. Any complaints regarding the functioning of the Service or access to Materials should be submitted electronically to the following email address: sekretariat@technokabel.com.pl.
9.2. The complaint should include at least: (a) contact details of the person submitting the complaint (e.g. email address), (b) a description of the issue subject to the complaint, and (c) the expected method of resolution.
9.3. Technokabel S.A. shall review the complaint within 14 days from the date of its receipt.
9.4. The response to the complaint will be sent electronically to the email address from which the complaint was submitted or to another address specified in the complaint.
9.5. Matters not regulated by these Terms and Conditions shall be governed by Polish law, in particular the Act on the provision of electronic services.
9.6. Any disputes arising from the use of the Service by Users who are not Consumers shall be resolved by a competent common court according to general jurisdiction rules.
9.7. These Terms and Conditions were adopted on 01.03.2026 and are effective from 01.03.2026 (version no. 1).
